Coddingtown gets court order to evict Narsi's

Coddingtown Mall on Monday obtained a court order allowing it to evict Narsi's Hof Brau after 26 years in business.
The document, called a writ of possession, is the latest step in a two-year legal battle between Simon Property Group, the nation's largest mall owner, and Narsi Samii, the long-time owner of the popular cafeteria-style restaurant.
The mall wants Samii out to make way for a larger destination restaurant that will help revitalize the aging center. Samii claims Simon, which purchased a 50 percent interest in the mall in 2005, is evicting him to avoid paying him for the remaining years on his lease. A judge ruled against Samii earlier this year, and the judgment became enforceable Sunday.
Samii said he was to meet with an attorney Tuesday to discuss his options. “I'm not going to let my guard down until the last second,” Samii said Monday evening.
Mall officials said they're not sure when the eviction would take place. “I think it could take a week to two weeks, I don't know,” said Kim Hall, marketing manager for Coddingtown and Santa Rosa Plaza, which Simon also owns.
Hall said she's not sure if previous offers to move Narsi's to another location in the mall still stood.
The order contains a provision allowing for the court to hear objections. Sheriff's Department officials declined to say whether they had been asked to enforce the order.
