Phone calls land Sonoma burglar back in jail

A San Mateo woman who admitted burglarizing the home of a Sonoma Valley family killed in a car crash is back in the Sonoma County jail after two phone calls put her afoul of the law.

Amber True, 30, appeared in court Friday on charges she violated the terms of her probation by talking on the phone to her co-defendant and boyfriend, Michael Gutierrez, 27, who is in jail awaiting transport to state prison.

Prosecutor Mike Li said two calls from Gutierrez to True's cell phone were made Oct. 27, just hours after Judge Arthur Wick sentenced True to probation and county jail time instead of a recommended six-year state prison term.

Li said the two collect calls -- 20 and 40 minutes in length - were recorded by jail staff. He said they violate the judge's stay-away order and expose True to a new sentence that could include prison.

True, who appeared before Wick in a blue jail uniform, denied the new charge. According to the complaint, True maintains Gutierrez tried to call her but she immediately hung up the phone.

A hearing on the matter is Monday morning.

True and Gutierrez were found guilty of looting the home of John and Susan Maloney three days after they were killed in a crash on Lakeville Highway while returning home from a family vacation. Also killed were children Aiden, 8, and Grace, 5.

Both defendants contend they didn't know about the tragedy.

Gutierrez, who had a long criminal record, was given eight years in prison. Wick cited True's youth and lack of a record in allowing her to avoid a more serious punishment.
