Juilliard Park rape suspect released pending charges

A 20-year-old Santa Rosa man accused of raping a teenage girl last month at Juilliard Park was ordered released from jail Thursday after prosecutors asked for more time to file charges.

Byrnes was accused of grabbing a 17-year-old girl the night of Sept. 6, removing her clothes and raping her.

Police arrested him Tuesday, saying they had DNA evidence linking him to the attack. In addition to rape, he was accused of oral copulation and sodomy. His bail was set at $100,000.

But Judge Robert LaForge ordered Byrnes released Thursday when prosecutors didn't file a complaint. He ordered both sides to return

Nov. 26 for an arraignment on any charges.

Police accused Byrnes of assaulting the girl when she asked to use his cellphone. He handed her the phone and attacked her, police said.
