BENICIA — Police say an intoxicated man was shot by the homeowner after breaking into a house he thought was his own.

The Oakland Tribune (http://bit.ly/1z1eqOH) reports the man, later identified as 24-year-old True Hatch was taken to an area hospital with non-life-threatening injuries.

Hatch told police he believed he was at the right house in Benicia and had just locked himself out after a night of drinking.

Hatch, however, does not live in the city, police said.

Benicia police Lt. Mike Greene said Hatch was shot once in the torso by the 66-year-old homeowner early Wednesday.

Police are not pursuing criminal charges against the homeowner, who told officers he acted in self-defense.
