OFFICIAL RULES FOR CHANCE PROMOTIONS

NO PURCHASE REQUIRED TO ENTER OR WIN THE SWEEPSTAKES.

One entry per person per day, prize. One prize per person. Must be 21 or older to win; ID required.

1. The Promotion: ' Sonoma Summer Sizzle'

The Press Democrat [Sponsor(s)] Sweepstakes offers ONE (1) winner a Sonoma Summer Stay-ca-tion package.

2. Prizes

Prize Package : Sonoma Summer Stay-ca-tion: a Fairmont Sonoma Mission Inn & Spa Get Away Package

Unwind in luxury and enjoy a Fairmont Sonoma Mission Inn get-away for two people that includes overnight accommodations for two guests, for 2 consecutive nights in a shared Heritage category room and a 3 course dinner for two at Sante Restaurant. The dates of your stay and dinner are based on availability and reservations are required. Total Prize Value $1,300

Entries must be received between 12:01 am June 30 and 11:59 pm September 7, 2015. One winner will be picked in a random drawing on September 14, 2015 from all eligible entries received and notified by email. Winner must respond by email or phone within 3 days of notification or the prize will be forfeited.

Winner will be notified via email on the date specified above. Winner must include correct email with their entry, and acknowledge notification by email or by a phone call to the company at (707) 526-8605 within 3 days of notification or the prize will be forfeited.

3. How to Enter/Eligibility

NO PURCHASE REQUIRED. Up to 8 entries per person permitted each week through the duration of the contest.

To be eligible to be included in the random drawing, each entrant must fill in the online entry form with their name and a valid email address and phone number, or by submitting a photo on our Summer Sizzle photo gallery (all participants will be automatically entered when submitting a photo to our Sonoma Summer Sizzle photo gallery in accordance to submission guidelines). Entries can also be made by mailing or dropping off to our Santa Rosa office location of the Press Democrat at 427 Mendocino Avenue, Santa Rosa CA 95401. Your entry must be legible and include the words SONOMA SUMMER SIZZLE and include your name, phone number, and the date on each entry you submit. In addition, the following eligibility requirements must be satisfied:

The promotion is open to any person who is (i) a legal resident of the 50 United States or the District of Columbia and (ii) over the age of 21 years old.

The winner must have a valid driver's license or other identification and the ability to legally travel within the United States. In order to claim the prize, the winner must meet all eligibility requirements and may be required to execute an affidavit of eligibility and liability/publicity release within seven (7) days following the date of attempted notification. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.

This promotion is not open to (i) employees, consultants, contractors or service providers of The Press Democrat, Pressdemocrat.com or its affiliates or any of its affiliates or subsidiaries, (ii) any person directly or indirectly involved with the organization of the promotion (including but not limited to any employee, consultant or contractor of any promotion, advertising or other marketing agency working for The Press Democrat, Pressdemocrat.com or its affiliates) or (iii) the immediate family members of either of the above (i) or (ii).

All photos must be taken in Sonoma County

Anyone who meets our prize eligibility requirements can submit a photo.

Photos may be ones taken in the past- they do not need to be recent, but they do need to be a photo taken during the summer months (June through the end of August) and should reflect summertime in Sonoma County.

We reserve the right to not publish any photo we choose if we deem the photo may be offensive to any of our readers or viewers.

One photo submission each week on Mondays, will be chosen as a photo of the week and will be featured in the Press Democrat each Friday through September 11, 2015, sponsored by Sonoma Outdoor.

No substitution, transfer, or assignment of the Prize is permitted, except that The Press Democrat, Pressdemocrat.com or its affiliates reserves the right to substitute a prize of equivalent value in the event the offered Prize is unavailable. All taxes on the Prize are the sole responsibility of the winner. There is no alternative for payment of the Prize in cash or otherwise.

Void where prohibited by law. Odds of winning a prize depend on the number of eligible entries received. Limit one prize per person, per promotion, regardless of the number of promotions entered into with The Press Democrat, Pressdemocrat.com or its affiliates. Non-winning entries from any drawing will not be carried over into subsequent prize drawings.

Entrants hereby grant to The Press Democrat, Pressdemocrat.com or its affiliates the right to use and publish their name and state online, in print, and in any other media in connection with the promotion. Acceptance of the Prize constitutes permission for The Press Democrat, Pressdemocrat.com or its affiliates to use winner's name, photographs, audio and/or visual recordings and likenesses for advertising and promotional purposes without additional compensation unless prohibited by U.S. law.

The Press Democrat, Pressdemocrat.com or its affiliates assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, or destruction or unauthorized access to, or alteration of, entries. The Press Democrat, Pressdemocrat.com or its affiliates is not responsible for lost, late, incomplete or misdirected entries or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, or software, or for failure of any e-mail or entry to be received by The Press Democrat, Pressdemocrat.com or its affiliates on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this promotion.

The Press Democrat, Pressdemocrat.com or its affiliates reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the promotion if for any reason the program is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of The Press Democrat, Pressdemocrat.com or its affiliates that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this promotion. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the promotion is a violation of criminal and civil laws and, should such an attempt be made, The Press Democrat, Pressdemocrat.com or its affiliates reserves the right to seek damages from any such contestant to the fullest extent permitted by law.

The Press Democrat, Pressdemocrat.com or its affiliates cannot and does not accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the promotion or as a result of accepting any Prize. By entering, participants release and hold harmless The Press Democrat, Pressdemocrat.com or its affiliates and its affiliates and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with this promotion or any prize won.

Entrants are required to comply with any and all applicable federal, state, and local laws, rules, and regulations.

A) All Photographs (a) must be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Sponsor, is suitable for all persons over the age of 13, (b) must not, in the sole and unfettered discretion of the Sponsor contain any sexually explicit, disparaging, libelous or other inappropriate content or any nudity; and (c) must not, in the solddiscretion of Sponsor, contain any commercial content that promotes any product or service other than ; (d) must not contain any copyrighted works (other than as owned by the Contest Entrant). Any elements appearing in your Photograph must be entirely original, created by you. Use of any Elements or other materials that are not original, or in the public domain may result in disqualification of Photograph in Sponsor's sole discretion.

B) Each Entrant retains ownership of any Photograph he/she enters into the promotion. However, as conditions of entry, each Entrant:

WARRANTS AND REPRESENTS THAT THE ENTRANT OWNS ALL RIGHTS TO THE PHOTOGRAPHS HE/SHE IS SUBMITTING.

WARRANTS AND REPRESENTS THAT THE ENTRANT IS THE INDIVIDUAL PICTURED, OR ALTERNATIVELY, THAT THE ENTRANT HAS OBTAINED PERMISSION FROM EACH PERSON WHO APPEARS IN THE ENTRY MATERIALS TO GRANT THE RIGHTS TO THE SPONSOR DESCRIBED IN THESE RULES, AND CAN MAKE SUCH PERMISSIONS AVAILABLE TO SPONSORS UPON REQUEST;

WARRANTS AND REPRESENTS THAT (a) HIS/HER ENTRY MATERIALS ARE ORIGINAL AND HAVE BEEN LEGALLY OBTAINED AND CREATED, AND DO NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OR ANY OTHER LEGAL OR MORAL RIGHTS OF ANY THIRD PARTY.

Irrevocably grants to Promotion Entities and their affiliates, legal representatives, assigns, agents and licensees, the worldwide, royalty-free, non-exclusive, sub licensable, unconditional, perpetual and transferable right and license to copyright (only as applicable), reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Entrant's name, address, image, likeness, statements, biographical material and Entry Materials, including, but not limited to, the Photographs contained in any of the above items, as well as any additional photographic images and other materials relating to the Entrant and arising out of his/her participation (with or without using the entrant's name) (collectively, the 'Additional Materials') (in each case, as submitted or as edited/modified in any way, whether by the Promotional Entities, their Licensees, or assigns, in the Promotion Entities' sole discretion) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from the Entrant or any other party.

Irrevocably grants to Promotion Entities and their affiliates, legal representatives, assigns, agents and licensees, the worldwide, royalty-free, non-exclusive, sub licensable, unconditional, perpetual and transferable right and license to use the Entry Materials for advertising, promotional or commercial purposes, including without limitation, the right to publicly display, reproduce and distribute the Entry Materials in any media format or medium and through any media channels.

C) Forever waives any rights of privacy, intellectual property rights, and any other legal or moral rights that may preclude Promotion Entities' use of the entrant's Entry Materials or Additional Materials, or require the Entrant's permission for Promotion Entries to use them for promotional purposes, and agrees to never sue or assert any claim against the Promotion Entities' use of those Materials.

Acknowledges and agrees that (a) Sponsor has access to and/or may create or have created literary, visual and/or other materials, ideas and concepts which may be similar or identical to the Entry Materials in theme and/or other respects: (b) the Entrant will not be entitled to any compensation or other consideration because of the use by Sponsor of any such similar or identical material, ideas and/or concepts: and (c) Sponsor's use of material containing elements similar to or identical with those contained in the Entry Materials or any Photograph shall not obligate Sponsor to negotiate with nor entitle Participant to any compensation or other claim.

Agrees to indemnify and hold the Promotion Entities and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the 'Promotion Indemnitees'), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Promotion Indemnities arising out of or in connection with (a) any Entry Materials or Additional Materials (including, Submission Guidelines or terms of service or in any documentation submitted by Participant; or (c) the entrant's conduct during and in connection with this Promotion, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation.

Entrants agree to abide by the terms of these official rules and by the decisions of The Press Democrat, Pressdemocrat.com or its affiliates, which are final and binding on all matters pertaining to this promotion. This promotion is governed by the laws of the State of California and the courts in Santa Clara, California shall have jurisdiction over any dispute arising from this promotion.

4. Winners

Winner will be determined in random drawings from all eligible entries by 5 pm on September 14, 2015. The decision of the judges is final. The winner will be notified by email. Winner must include correct email with their entry, and acknowledge notification by email or by a phone call to the company at (707) 526-8605 within 3 days of notification or the prize will be forfeited. Entrants are limited to winning one prize package for the duration of the contest. Sponsor(s) is not responsible for late, misdirected, or unsuccessful efforts to notify prizewinners or to acknowledge receipt of notification. The winner will be required to execute a declaration of eligibility that winner has complied with all the rules (if a trip is a prize: that winner and any traveling companion release Sponsor(s) of all liability in connection with the prize trip and/or if the prize is goods or services, the winner(s) release(s) Sponsor(s) and all prize-supplier companies from all liability for damages or personal injury in connection with the winner's use of the prize goods or services) and consent that the Sponsor(s) and anyone it/they may authorize may without compensation use winner's name, photograph or other likeness, biographical information and statements concerning the sweepstakes or the Sponsor(s) for purposes of advertising and promotion. The declaration must be completed before receiving the prize or an alternate winner will be selected. Odds of winning are determined by the total number of entries received. Taxes are the responsibility of winners. Company reserves the right to cancel or modify the contest if Company determines, in its sole discretion, that fraud or technical failures, including viruses, bugs, non-authorized human intervention or other causes beyond the control of Company have impaired the integrity of the contest.
