Opponents appeal approval of Santa Rosa asphalt plant's silos

The neighborhood group that tried unsuccessfully to block upgrades to Santa Rosa's BoDean asphalt plant is appealing a local judge's ruling supporting the project.

Citizens for Safe Neighborhoods last week filed an appeal of Sonoma County Superior Court Judge Elliot Daum's October ruling upholding the city's decision to allow BoDean Co. to add three 82-foot storage silos to its plant on Maxwell Drive.

The group, made up mostly of residents of the West End neighborhood, argued the city should have required BoDean to conduct a full environmental review of the $1.5 million project because the plant is located in a primarily residential area.

But Daum found additional studies were not necessary in part because the upgrades were aimed at improving the efficiency of the plant, not increasing its production capacity.

"I think the Superior Court decision was correct and expect that the decision will be upheld," Assistant City Attorney Molly Dillon said.

The case is being heard in the 1st District Court of Appeal in San Francisco.
