49ers' Colin Kaepernick named in Miami police report(w/video)

"There's no evidence of a crime or a sexual assault," Pimental said. "This report is simply an incident report taken at the woman's request."

The incident was initially reported online by TMZ as a sexual assault, but Pimental said the celebrity gossip news site "took the report out of context."

Team officials have not released any information about the report.

"The 49ers organization is aware of a report regarding Colin Kaepernick and are gathering facts," 49ers general manager Trent Baalke said in a statement.

Kaepernick was scheduled to attend teammate Anquan Boldin's "Q-Fest" charity function in Palm Beach Gardens that runs Thursday through Saturday.

Coach Jim Harbaugh told reporters at the Q-Fest event that he hasn't spoken to Kaepernick since details of the alleged incident surfaced earlier Thursday. "I'm aware (of the incident), but don't have anything else that I know anything about," Harbaugh told ESPNWestPalm.com.

Kaepernick's agent, Scott Smith, did not immediately return a phone message seeking comment.

The woman, whose name was removed from the report, told detectives she went to Lockette's apartment at the Viceroy Miami — a luxury resort on Brickell Avenue — to mingle with Kaepernick and wide receiver Quinton Patton and that she "mixed some drinks for them and gave them shots."

The players allegedly told her that, in order to drink with them, she needed to smoke marijuana.

The woman said the group then watched a basketball game, and shortly after she started to feel lightheaded so she went to a bedroom to rest. She says Kaepernick, with whom she has had a previous sexual relationship, came to the room and kissed her and undressed her, the report continues. She told police they did not have sex.

Kaepernick then reportedly left her naked in the bedroom. Shortly after Patton and Lockette opened the door and peeked inside, the report states. She said she asked "What are you doing? Where is Colin? Get out!" The men then left.

The woman told detectives she woke up later in a hospital not knowing how she arrived there. Police also did not know how she arrived there.

The report did not detail why she was in the hospital and police said federal medical privacy laws prohibit them from releasing the name of the hospital, what she was treated for and if a rape kit was conducted.

Lockette, 27, shared a house with Kaepernick before getting cut from the 49ers in last year's training camp. Lockette then signed with the Seattle Seahawks and played on their Super Bowl-winning team. Patton, 23, is entering his second season with the 49ers, having had his rookie year hindered by hand and foot injuries.

Patton, whose 2013 rookie season hindered by hand and foot injuries, has been working out with 26-year-old Kaepernick this offseason.

Kaepernick has been training the past two months at Bommarito Performance Systems in North Miami Beach, which is where 49ers running back Frank Gore often trains in the offseason. Joining Kaepernick for 5-day-a-week workouts have been teammates Quinton Patton and Nick Moody, along with other NFL players.

Coming off his first full season as the 49ers' starting quarterback, Kaepernick is entering the final year of his rookie contract and is set to make $973,766 in base salary. However, the 49ers and Kaepernick's representatives began talks two months ago on a multiyear extension that likely would make Kaepernick one of the NFL's best paid quarterbacks.

Kaepernick has rocketed to stardom in 1½ seasons, since assuming arguably the NFL's most decorated quarterback throne, where Joe Montana and Steve Young produced Super Bowl wins en route to the Pro Football Hall of Fame.

A 2011 second-round draft pick out of Nevada, Kaepernick is 17-6 as a regular-season starter and 2-1 in each of the past two postseasons.

He burst on the national scene upon replacing Alex Smith midway through 2012, dominating in his starting debut against the Chicago Bears and culminating that season with a near-comeback in Super Bowl XLVII against the Baltimore Ravens. Last season, Kaepernick endured growing pains before finishing strong, highlighted by playoff wins at Green Bay and Carolina before a NFC Championship game loss at Seattle.

The NFL did not immediately return requests for comment, but marijuana is on the league's list of banned substances.
