Preliminary hearing set for man accused in Healdsburg murder

After his failed bid to get his case tossed on grounds of prosecutorial misconduct, a Healdsburg murder suspect was in court Wednesday morning and received a Nov. 3. date for a preliminary hearing.

Jarrod Miller, 29, appeared in a blue jail uniform before Judge Arthur Wick, who previously found there was no wrongdoing when detectives eavesdropped on a visit from his brother.

The case will now proceed to the evidentiary hearing, which prosecutor Scott Jamar estimated would take three hours.

Miller is accused of killing his sister's boyfriend, Timothy Neuer, also 29, at his Alexander Valley home on March 8.

Police said he pulled a gun after a confrontation and shot Neuer several times in front of Mandy Miller. Witnesses called 911 and police arrived in time to arrest Miller as he drove on a nearby road.

Officers recovered a gun they believe Miller tossed from his car. Family members said Miller had suffered mental health problems for years.

Miller spoke quietly with his lawyer, Joe Bisbiglia, before the preliminary hearing was set.

Bisbiglia had argued the case should be dismissed because of a secret recording made of a jailhouse visit between Miller and his brother. He argued detectives enlisted the brother to get information from Miller, acting as a state agent.

Also, Bisbiglia said several laws were broken, including the accidental recording of an unrelated defendant and his lawyer.

Wick said there were no grounds to toss the case or remove the district attorney from prosecuting it.
