In an election that could reshape the makeup of the Sebastopol City Council, the top vote-getter in a race for two seats was Robert Jacob.
The race for the second seat between challenger John Eder and Councilwoman Kathleen Shaffer is too close to call, since there are mail-in and provisional ballots that have not been counted, election officials said.
With absentees and all precincts reporting, Eder led Shaffer by nine votes.
Jacob and Eder are opponents of the controversial CVS Pharmacy-Chase Bank branch project, which passed on a 3-2 council vote and was the divisive issue in the election.
Shaffer, who was seeking re-election, supported it, as did Mayor Guy Wilson, who did not seek re-election.
Opponents are holding out hope that a new council majority could yet defeat the project, although the developer, Armstrong Construction of Sacramento, has all of the major approvals. The purchase of the property by CVS closed on Friday.
With absentees and all precincts counted, Jacob, 35, who is founder and executive director of the nonprofit Peace In Medicine medical marijuana dispensary, had 28.9 percent of the vote. Jacob, who opposed the project, will take Wilson's seat and presumably swing the council against the project.
Eder, 59, was second with 24.9 percent.
Shaffer was third with 24.8 percent.
Kathy Austin, 60, an architect, had 19 percent and Colleen Fernald, 2.4 percent.
Measure Y, a half-percent sales tax increase, was passing, with 70.8 percent approval.
