A Rohnert Park man accused of fleeing a Lakeville Highway crash that killed a 17-year-old driver had no alcohol in his system, prosecutors said Monday.
The results of a drug test on Michael Harmon, 41, are pending, said Jane Murray, a deputy district attorney. Criminal proceedings will be on hold until July 30, when lawyers for both sides expect to hear back from toxicologists in Sacramento.
Harmon could then either deny vehicular manslaughter charges in the death of Jahzeel Forsen of American Canyon or attempt to resolve the case, said his lawyer, Kristine Burk.
"Without these materials neither side feels they have a factual basis," Burk told Judge Knoel Owen Monday morning.
The victim's family appeared in court Monday but declined to comment.
Harmon turned himself in July 2, about 10 hours after the crash outside Petaluma.
He was headed south on Lakeville Highway after midnight when he lost control of his Ford F-150 pickup and collided with the teen's northbound truck, the CHP said.
A witness told officers the driver got out of the wrecked Ford, walked over to the other pickup and peered inside at the dead teen.
He then disappeared into the night on foot, leaving his truck at the scene.
A witness description of the driver helped connect Harmon to the crash, Officer Jon Sloat said.
Prosecutors said he later admitted being the driver and using drugs or alcohol.
