PD Editorial: Bills signed, vetoed for area legislators

Here's our end-of-session update on bills sponsored by Assembly members representing Sonoma County.|

On Monday, we updated legislation by local senators after Gov. Jerry Brown finished signing and vetoing bills passed in 2014. Today we do the same with bills by Assembly members Wes Chesbro, D-Arcata; Mark Levine, D-San Rafael; and Mariko Yamada, D-Davis.

Chesbro’s bills include:

AB 388: Originally dealing with community colleges, bill was amended to

Establish measures intended to reduce the frequency of law enforcement involvement and delinquency petitions of minors in dependency who are placed in group homes or other non-foster family placements. Signed by the governor.

AB 504: Extends existing law governing harvest of sea cucumbers and prohibits hatchery production or other cultivation of transgenic salmon. Signed by the governor.

AB 520: Updates law allowing wine and spirits wholesalers to conduct retail on-sale tastings. Signed by the governor.

AB 881: Originally dealing with oil spill and prevention fees, bill was amended to allow Sonoma County and its cities to raise sales taxes 0.5 percent above the state cap to fund road repairs of libraries. Died in Senate Rules Committee.

AB 997: Defines the role of local enforcement agencies under the state recycling act. Died in the Senate.

AB 1101: Extends indefinitely the time during which oversized trucks transporting livestock may travel on Highway 101 in Del Norte, Humboldt and Mendocino counties. Signed by the governor.

AB 1570: Increases training requirements for licensees and staff working residential care facilities for the elderly. Signed by the governor.

AB 1595: Brings law regarding the state Council on Developmental Disabilities into conformity with the federal Developmental Disabilities Assistance and Bill of Rights Act of 2000. Signed by the governor.

AB 1618: Permits certain specified tribal officials access to juvenile court case files of children who are members of or eligible for membership in, that tribe. Signed by the governor.

AB 1642: Extends sunset dates for provisions relating to Pierce’s disease and the glassy-winged sharpshooter. Signed by the governor.

AB 1782: Increase from $500 to $10,000 the maximum fine for illegally severing or removing telegraph, telephone, cable TV or other lines used to conduct electricity. Signed by the governor.

AB 1826: Phases in requirement for generators of specified amounts of organic waste to arrange recycling services for that material. Signed by the governor.

AB 1847: Deletes certain offensive and outdated terms once used to describe mental health conditions and disabilities in various statutes and replaces them with more current, less offensive, terms. Signed by the governor.

AB 1914: Requires the state Water Resources Control Board to conform water permits that affect the Trinity River to instream flow requirements established by the federal government. Died by Assembly Appropriations Committee.

AB 1943: Reduces city of Eureka’s payments to the state for tidelands in Humboldt Bay. Signed by the governor.

AB 1946: Involves high schools in small, rural school districts. Died in Assembly Appropriations Committee.

AB 1989: Allows underage students in winemaking and brewing programs to taste alcoholic beverages as necessary for class. Signed by the governor.

AB 2004: Originally requiring an annual report on enforcement activities of the Alcoholic Beverage Control Department, bill was amended to allow beer sales at farmers markets and to allow craft brewers to sell beer at private events. Signed by the governor.

AB 2005: Originally dealing with beer labels, bill was amended to expand membership of the California Horse Racing Board to include four representatives of the Legislature. Vetoed by the governor.

AB 2035: Clarifies that a juvenile who is determined to be a victim of commercial or sexual exploitation may be rendered a dependent of the court and increases training requirements on individuals required to provide assistance and support to commercially and sexually exploited children. Vetoed by the governor.

AB 2142: Originally dealing with timber sales, bill was amended to add Sonoma, Mendocino, Humboldt and Del Norte counties to a forest fire prevention pilot project that involves harvesting timber to clear fuel for wildfires. Signed by the governor.

AB 2184: Authorizes the use of money from the state Forest Restoration Fund for grants to remediate land damaged by marijuana growing operations. Died in the Senate Appropriations Committee.

AB 2203: Prohibits the obliteration, mutilation or marking out of a manufacturer’s name on metal beer kegs. Signed by the governor.

AB 2239: Involves changes of ownership of forest land covered by nonindustrial timber management plans. Signed by the governor.

AB 2352: Involves enrollment priorities at community colleges for students concurrently enrolled in high school. Died in Senate Appropriations Committee.

AB 2465: Requires Cal Fire to create a uniformed prescribed burn plan template for forest fuel treatment. Vetoed by the governor.

AB 2592: Requires the California Horse Racing Board to conduct an economic analysis whenever it considers a calendar change involving more than three days for county fair horse racing. Vetoed by the governor.

Levine’s bills include:

AB 288: Requires California Coastal Commission to issue meeting notices in English and Spanish. Signed by the governor.

AB 582: Require that Palm Drive Health Care District certificates of participation be secured by a lien on revenue generated from the district’s parcel tax. Signed by the governor.

AB 745: Allows open space districts to enter contract worth up to $25,000 without bidding. Signed by the governor.

AB 747: Allows the state Transportation Commission to relinquish an abandoned freeway route to city of Tiburon. Signed by the governor.

AB 1163: Requires CalPERS to establish a policy for providing education for board members. Signed by the governor.

AB 1171: Authorizes a pilot project allowing foster youth and nonminor dependents to create and access a personal online electronic record. Died in Senate Appropriations Committee.

AB 1234: Expands confidentiality protections for information submitted by insurers to the state insurance commissioner, including making it inadmissible in civil court. Signed by the governor.

AB 1537: Creates a pilot program for Marin County to utilize a “suburban” default density standard for accommodating its share of affordable housing. Signed by the governor.

AB 1933: Authorize local governments to invest surplus funds in dollar-denominated senior unsecured unsubordinated obligations issued or unconditionally guaranteed by certain banks. Signed by the governor.

AB 1969: Requires CSU and community colleges, and requests UC, to coordinate efforts when procuring technology and software. Vetoed by the governor.

AB 1995: Allows the Bel Marin Keys Community Services District to enforce covenants, conditions, and restrictions. Signed by the governor.

AB 2042: Originally dealt with leased cars, bill was amended to establish a waiting list for state Air Resources Board’s air quality improvement program. Died in the Senate Transportation and Housing Committees.

AB 2071: Requires state agencies to determine whether using disinfected tertiary-treated recycled water for pasture animals is safe for public and animal health. Signed by the governor.

AB 2098: Requires courts to consider a defendant’s status as a veteran suffering from post-traumatic stress disorder or other forms of trauma when making specified sentencing determinations. Signed by the governor.

AB 2101: Allows local contracting agencies involved child care and development services to maintain electronic records. Died in Assembly Appropriations Committee.

AB 2152: Places limits and restrictions on colleges and universities contracting with federal intelligence agencies. Died in Assembly Appropriations Committee.

AB 2178: Establishes a blended learning pilot program, administered by the state Board of Education Died in Assembly Appropriations Committee.

AB 2198: Requires mental health professionals to complete a training program in suicide assessment, treatment and management. Vetoed by the governor.

AB 2264: Originally dealing with Indian tribes and health, bill was amended to allow crime victim restitution claims by disabled persons whose service dogs are killed or disabled in a crime and defendant cannot afford restitution. Signed by the governor.

AB 2297: Allows health facilities to use alternative clean energy technologies as primary or backup power sources. Died in Senate Appropriations Committee.

AB 2355: Requires local governments to adopted standards developed by Caltrans for recycled paving materials, or discuss why it is not adopting those standards at a public hearing. Signed by the governor.

AB 2393: Allows counties to double an existing $1 fee on all motor vehicles to fund fingerprint identification systems; counties that don’t assess the fee would be allowed to impose a $2 per vehicle fee. Signed by the governor.

AB 2398: Establishes a fine of up to $300 for motorists who injure vulnerable road users, such as pedestrians and cyclists. Vetoed by the governor.

AB 2457: Makes it misdemeanor, subject to six months in jail and a fine, to commit an assault or a battery at a stadium or arena on an event day. Died in the Senate Appropriations Committee.

AB 2488: Allows instructional wine tasting at certified farmers’ markets. Signed by the governor.

AB 2543: Allows an evaluation panel, rather than the treating psychiatrist, to determine whether a defendant has regained competency to stand trial. Died in Assembly Public Safety Committee.

Yamada’s bills include:

AB 1434: Requires state agencies to develop a plan for funding and implementation of a program to provide funding assistance for water service to households with less than 200 percent of the federal poverty guideline level. Died in Senate Appropriations Committee

AB 1553: Prohibits gender pricing for long-term care insurance policies. Died in Assembly Insurance Committee.

AB 1580: Consolidates the morale, welfare and recreation funds at each state veterans home into a newly created fund in the state treasury. Died in the state Senate.

AB 1816: Requires the Department of Public Health to set a performance benchmark, not to exceed 60 days, to complete a long-term care facility complaint investigations. Died in the Senate Appropriations Committee.

AB 1965: Authorizes restaurants to allow pet dogs in outdoor dining areas. Also allows local government to adopt ordinances prohibiting dogs in outdoor dining areas. Signed by the governor.

AB 2144: Requires state Department of Public Health to establish minimum nurse-to-patient ratios for acute care psychiatric hospitals. Died in the Assembly Appropriations Committee.

AB 2251: Clarifies the authority of the state Department of Food and Agriculture (CDFA) and county sealers to enforce over-collection of the California Redemption Value on beverage containers. Signed by the governor.

AB 2349: Establishes the Office of Community Care Coordination within the Department of Developmental Services to be located on the grounds of the Sonoma Developmental Center campus. Died in Assembly Appropriations Committee.

AB 2505: Allows dairies with no more than three cows or water buffalo or 15 goats, sheep or other hooved mammals to sell raw milk. Died by Assembly Agriculture Committee.
