December trial set for Dutra asphalt proposal

Sonoma County Judge Rene Chouteau has set a tentative trial schedule for the lawsuit challenging the proposed Dutra Materials asphalt plant south of Petaluma.

Opening briefs are to due Sept. 14, with response briefs due Oct. 14. The trial start date is Dec. 9.

Sonoma County, Dutra and its business partners are being sued by the city of Petaluma, five environmental and community groups and several individuals.

Citing what it says are unresolved environmental and public health concerns from the plant, the coalition seeks to overturn the final approval given by the county Board of Supervisors in a 3-2 vote Dec. 14 and require a new environmental review of the project.
